Many cities and counties have outlawed gravel drives. If you have one it is grandfathered and you can maintain it but not expand it. When it was paved them your drive may have lost that status and must now stay paved. Depends on the rules in your town. You might have the asphalt removed and one one will notice or care but one hyper busybody could turn you in then you would have to pay to have it repaved and possibly a fine. If you are concerned about water flow to your house you might consider permeable pavers. These are either pavers that are porous and let water flow through; or they are laied with wider gaps that let the water between. Google it and there should be lots of info.
