You are caught between choosing to poison the wasps, and risk the birds, or not killing the wasps, which can destroy even full grown birds. You might try spraying the ground with a mixture of garlic extract and water. No kill, but it should repel them.

How to safely get rid of a ground nest.
If a baby bird landed by the nest will Yellow Jackets kill a baby bird?
We usually use a wasp spray to kill them but a friend lives in a
housing community and a nest of baby birds is right above where she
thinks the ground yellow jackets are.
I'm not sure what to tell her.
